I am going through a custody battle with my son's father at the moment. We had just went to JDR Court back in February where he was asking for full custody once again and lost. We share custody of our son 50/50. He appealed the judge's decision on March 24th in the Circuit Court and that appeal is scheduled for May 16th. This will be the sixth time inside a court house in the past two years. The father's girlfriend is living with him and is around my son every other week. When my son came home last night from spending the week with them, he was rather distant and quiet. I had asked him what was wrong, he said nothing. I asked if someone was mean to him during the week and he said yes. I had asked him who and he had said the girlfriend's name. I asked what did she do and he said that she slapped him. I had asked why and he told me the reason why, because he slapped his grandpa which is the father's father. What right does the girlfriend have to lay her hands on my child? They are not married, not engaged, just live in girlfriend and boyfriend. Two weeks ago my son had said don't make me slap you out of that chair while sitting at the table upon returning home. I had asked him who said that to him and he responded back with the girlfriend's name. Both his father and the girlfriend have my son calling her Anna Mommy. What gives them the right to take that right away from me when I am his mother and a very active part of his life. What can be done about this situation? The downside is that my son will be turning 3 in a couple months. Is there anything I can do to present this when we go back to court. A lot of my friends tell me to file a police report about this and have the police talk to my son since it is still fresh in his memory. I have been told this morning as well that she has slapped in the face as well.

What was the car worth at the time of your mother's death and how much was owed on it? If the car was not worth what was owed, you could have called up the lender for your mother and told them to come and get the car. Whether there would be any deficiency owed is a different issue and would depend on your mother's other assets and debts. However, the lender would have to file a claim and would be given lowest priority.
Assuming there are enough assets in the estate to cover all other bills, then the beneficiary of the car takes the car subject to any outstanding liens and I assume that as you are the administrator, then there is no will and no directive that the liens are to be satisfied out of other estate assets. That means if the beneficiary wants the car he/she has to pay for it. Otherwise, the personal representative could sell the car, pay off the lien and put any profits back into the estate.
You do not have the car put in your name unless you are the only the only heir/beneficiary. Technically, you will have to buy the car from the estate and get a new car loan in your name to pay off the old loan unless the car lender is willing to put you on the existing loan. You will also have to provide any lender with documentation to prove that you are entitled to have the car in your name. You will then have to transfer the car as administrator of the estate to yourself but since the lienholders have the title you will have to coordinate this with the existing lienholder and any new lenders.
Any insurance should have been cancelled. She is no longer alive. The insurance should be in the name of the person who owns the car.
You have really messed this up. I hope you are the only heir. I suggest that you talk this over with a local probate attorney who practices in the county where the estate is or will be pending if none was ever probated and see what needs to be done to get assets properly transferred over to the heirs.

I hope another attorney will correct me if I am wrong, but I believe you will have to go through the name change process (including paying the filing fee.) As I understand the process is straight forward and is included upon marriage. Get an attorney who practices probate law in the county where your ex resided when he died. This is where the estate should be administered. You also need to find out if an estate has been opened for him.. If so you need to file a claim with the estate before you can be paid. If you don't file a claim, your claim can't be paid.
You need to understand that there is a priority in which claims are paid.
For example creditors are paid before beneficiaries. However some creditors are paid before others.

She was in a hurry trying to take her son the urgent care but was at the wrong building and the parking lot was a maze of dead ends. The security officer tried to to stop her but she panicked and left. It's been a couple of days since, and we took her license away when she told us. But we are worried the officer is going to tattle tale to the police department if they caught her on survillance. she has a clean record and is 28 with two kids. Can action be taken on her through third person, or does a cop have to be there to cite her. We don't want her to go to jail for reckless driving.

A message was inadvertently sent without grammar or spelling corrections at approximately 8:40 PM Pacific time on April 16, 2015. Please ignore. My question was to have read more simply that with escrow closing today on my mother's house in what we thought was an irrevocable trust that had been in place for 20 years prior to my mothers passing two months ago. It was found to have mistakenly been left in her name as a single woman when the title company was about to close escrow today on the sale of it. Another title company that we had used to refinance the house while it was in an irrevocable trust 18 months ago temporarily for a second refinancing of the house did not place it back in the irrevocable trust. We had thought they were doing that and we also had bought our attorney had followed up on this absolutely critical situation to have it put back in and air revocable trust. We were not proactive and triple checking this ourselves although I know we did inform the attorney that the refinance transaction was complete being very concerned that it was out of this 92 year old ladies trust that was set up for me.
Our concern is that Medi-Cal, for which she had hundreds of thousands of dollars in expenses paid for over the nearly 2 years in a nursing home and numerous operations would wipe out the $250,000 house value if indeed the state of California and Medi-Cal attempt to go after those funds that were in her name at the of Her death of February. Is Medi-Cal going to be able to put a lien on this house or will a favorable decision in a probate court with the Hagstedd Precedent on probate being able to stop any Medi-Cal action with this situation?

I'm not sure what the result is going to be because it's a matter as to what position is taken by the Estate Recovery Section of the Department of Health Care Services. I suggest that you obtain a court order declaring the property to be in the trust before you submit any statement to Medi-Cal stating that your mother did not own any real property upon your death.
Incidentally, the petition wouldn't be a Heggstad petition. Instead it would be a petition under Heaps v. Heaps, an appellate decision which stands for the proposition that trust property remains trust property unless the trust is revoked with respect to that property, even if the property was removed from the trust for refinancing purposes.

Not in a divorce case. If he loaned you money and has a security interest in the house, I suppose he could foreclose on the loan and take the house from you that way.
In a divorce, he could claim that he has a reimbursement claim against your sister's separate property estate for money expended on increasing the value of the house. If amount of the reimbursement claim is limited to the increase in value to the home, not the amount spent. For example, if the house were worth $100,000, then he spent $30,000 putting in a pool, and now it's worth $110,000, then that $10,000 difference in value would be the limit of his reimbursement claim. If this is a relevant scenario, just know that there are also equitable offsets that you and your sister can claim.
Be prepared to prove to the court that you and your sister owned the house before marriage so that you can establish that it is NOT community property.

You haven't told us what it was, how much it was worth, why you think it's fake, the method of payment, etc, all of which are necessary for an answer. This is probably NOT a criminal matter. Your remedy, depending on the things you chose to omit, could be a small claims lawsuit in magistrate court, hiring a lawyer, doing a credit card chargeback, making a claim on a site like eBay if it was bought there, etc. Not all of those will be your remedy but one may be, should you chose to give details. Some of your remedies have very short time periods.

I paid $625.00 cash to this person. I had purchased similar items from this person in the past so, I trusted him with this purchase. I inspected the item(guitar) in depth the following day and discovered it was a fake. Like I said, I contacted him and he maintained he did no know it was counterfeit and he said he would return my money. Now, he is ignoring my phone calls.

Based on your added information, with a $625 claim, your logical remedy is a small claims suit. You file this in Magistrate's Court in the county where the seller lives. The court has a claims form you use to start a case, and hearings come pretty quickly.

Most management models and theories were developed to help managers in a given situation or context to solve a set of problems. The context has changed.

A good consultant when working with a company will recognise the strengths and weaknesses in individuals and build the strategy around these.
Occasionally it is time to let some people go because they no-longer fit or support the direction (culturally & style) that is required for future sucess. Managers should not feel rejected if this happens as there will always be a more appropriate role for them in another organization.

Did all the parties being recorded give their consent to being recorded? If not you could have violated the Wiretap Act. That act applies even if you weren't using a telephone. Say you were making a video with sound. Before you plan to use your sound recording you might want to check with an attorney so you don't end up looking at a 3rd degree felony.

According to the trust either he or my husband, or both, may live in the house until they move out, at which time the house is to be sold and the proceeds split. My husband died in 2012 and now I wonder if our children would receive his share, even though they are not listed by name on the trust.

Your question, which is certainly a good one, cannot be answered without a review of the trust document. The trust may hold your husband's half of the home in trust for his children (or even you) until your brother-in-law's death or the termination of the trust. Or the trust may terminate now and leave the home outright to your brother-in-law. I have drafted different trusts with both of these provisions.

There are statutes that govern personal property left in rental premises after an eviction. They are set forth at Code of Civil Procedure section 1174, subdivision (e). You mention that you are in an eviction, so I am assuming that this was a lawful eviction, and not some form of "self help" that the landlord performed on his or her own.

The deed will describe you as a single man, not as a "married man." Theoretically you could have problems since your separate property from before the marriage doesn't necessarily transmute into community property. The proper action for you to take is to have a trust document drawn up properly putting your affairs in order inclusive of how the house (and all other substantial assets) are to be disposed of in the event of your death. I'd be happy to provide you this service and since you actually have substantial assets, you should do this via an attorney rather than via "canned trust" with a paralegal (which would be fine other than the fact you have real estate which necessitates a higher standard of care and justifies the extra expense of around $500-$1000. As Ron mentioned, someone will need to qualify to become an Administrator of the estate. The process may depend upon how large the estate is. You should consider speaking to an attorney to see who has the right to qualify. Usually the court favors the closest next of kin, but sometimes there are exceptions.
Note, you don't necessarily want to qualify if you think the estate will be a nightmare to administer or if there are more liabilities than assets...

First and foremost we are not in default. We refinanced our home in 2001. We have not refinanced since then. In 2001 we refinanced with Homegold Mortgage who was indicted for their lending practices. Since that time our mortgage has been sold numerous times.

There are two procedures in NC - one civil and one criminal for collecting on bad checks. Sounds like if this is in the clerk's office its criminal. I do not know where you moved or if you left the state - if so, statute of limitations may have been tolled. Have you returned to NC?

If so, then your question is can the hospital garnish wages while you are making payments.
First, no creditor (absent the federal government for a federal student loan) can just garnish your wages absent some type of court proceeding. If you owe money to a creditor, that creditor must first sue you and get a judgment if they wish to be able to enforce the judgment via wage garnishment.
The real question which you do not ask implicates a common myth. Most people that owe a medical debt think that they cannot be sued as long as they are sending in their payments or whatever they think they can afford ($10 or $25 or whatever). This is a MYTH! Hospitals and healthcare providers are in the business of providing for healthcare; they are not money lenders. If you need to make payments then get a loan, pay the hospital and then repay the loan. Hospitals can and do routinely turn people over to collections even where patients are paying money. And hospitals can sue you as well. So if you owe money to a hospital, the answer in short is yes, the hospital can sue you and get a money judgment and can garnish your wages even if you are making payments.
If you mean HOA (as in home owner's association) this does not really make sense because the HOA will file a lien for unpaid HOA assessments/dues and if you still do not pay they will foreclose on your property.

I'm not sure why you think you were dropped from the note. A debtor does not just "drop" from a note. The note is the note until it is paid off. Unless you and your parents signed a new note when the debt was sold (which I am 99.999999999% sure didn't happen) nothing about the note changed. If you mean your name doesn't appear on the statements, that is of no legal relevance. It probably just means their computer billing system doesn't have enough lines to print three names on bills. That has zero relevance to the legal status of the loan and the debtors on it. Since the IRS paperwork MUST show all borrowers, their system prints out your name on the tax documents. Again, other than telling the IRS who is entitled to take some or all of the interest deduction, this has no bearing on who is "on the note."

I believe there is a municipal ordinance in the code of ordinance about the city's "urban forest". The City of New Orleans Municipal Code of Ordinances is online. Google it and you can search through it. You will have to deal with the city and get their permission to cut it down. Don't act without their permission, as you could be fined.

"Against the law" as in the police will come and someone will get arrested? No. This is not a legal issue - or shouldn't be. What it is is a very bad sign for two people living together. Why would ether of you live with the other when you can trust them to have a mailbox key? In addition, is this arrangement allowed in the lease? If you can't trust someone with a key, don't live with them. If you are the one who is being denied a key, move out and don't live with someone who does not trust you.

Auctioneer gave me a contract to sign and new it would not take effect until the realtors contract was over. The realtor gave me a good written offer two days prior to the end of his contract which I accepted and advised the auctioneer that the house was under contract. The auctioneer is now looking for money claiming expenses etc. I asked him for receipts and he has not furnished any. I feel he is using extortion and harassing me. He is in new York and I have moved to Pennsylvania. The house was in New Jersey . The lawyer handling the closing does not want to get involved because he is semi retired but told me not to worry. The statute you reference applies to residential properties. There are far fewer restrictions regarding commercial rentals, but many of the same basic rules apply. In commercial rentals, the landlord has most of the power and there are almost no protections in place for the tenants.
Generally, once a lease expires, if the tenant stays on, he is now considered a month to month tenant. The rent will be whatever it was when the lease was in effect. It can be changed to whatever the parties agree on, and the landlord can give notice of an increase, usually a minimum of 30 days would be required.
So, until you give notice of an increase, the rent is what it was under the lease.
Often, commercial leases have a provision for these circumstances. Check your lease or contact a landlord tenant attorney for a consultation.

The operations manager told us we could not move into the tent,It rained and after calling the owner we were told it would be 1200$ to move into the tent. When the original contract was signed,the venue did not have a permanent tent, the contract stated that a tent would need to be rented from another source. Since the coordinator offered the tent and did not tell us of a charge I think we should not be charged. Your question isn't clear regarding who hired the wedding coordinator. If you hired the wedding coordinator, he or she would have no authority to bind the owner of the wedding site to alter the contract. If the wedding coordinator was an employee of the wedding sight, offering the idea of using the new permanent tent doesn't necessarily mean you didn't have to pay for it. You also could have picked up the phone instead of waiting for the coordinator's phone call.
You signed a contractor that said you would have to rent a tent if you wanted it. The operations manages had not legal duty to offer you the use of the tent for free. So far, I have not heard any legal reasons why they should have been required to offer you the free use of the tent. That might have been good customer service to do so, but that contract doesn't seem to require it.

You are looking at something that I suspect a court will refuse to okay (except possible if you and your ex and the bio-father all cooperate in court). By letting him sign the borth certificate and then saying it's his child in the divorce it IS his child legally, and it is highly unlikely a court will let you "basterdize the child" and also cancel his support. This is a case where "you made your bed and get to lie in it to use a proverb. Your odds are very slim, and you might even lose custody by trying something like this.

Ultimately, no, but if you are having to ask a lawyer about how to solve this, you have already failed. As roommates, NEITHER of you should have guests overnight if the other does not agree to it.

It is probably better to form a corporation or LLC in Delaware, because you would probably have to REGISTER a VIrginia corporation or LLC in Delaware anyway. So you then end up with a two-step process instead of a one-step process.
If you create a corporation or LLC in Virginia, then this would be considered a "foreign" (not domestic or out of state) company as far as Delaware is concerned. (NOTE: I am not a Delaware attorney, and I am not licensed in Delaware, but these are general principles that apply in all States.)
So if you create a Virginia corporation, you would then have the additional step of registering an out-of-state corporation or LLC in Delaware also. So you have almost twice as much paperwork and annual fees to maintain it in both States.
It is possible (I don't know Delaware law in detail) that if you only own one piece of property and don't do much business with the LLC in Delaware, you could get away without registering the company in Delaware. But if you are engaged in renting a lot, especially if you have to ever go to court and collect rent, then you would have to register in Delaware, also.
STRANGELY, I have already paid Legal Zoom for the creation of an LLC, including paying for the annual fee of a registered agent in Delaware... and my client has not made use of the LLC. (I created two, and my client has used one, and never got around to making any final decisions about the second. She never decided on a name.) So I have a paid order for an LLC in Delaware with Legal Zoom waiting to be processed (waiting for a final decision on the name).
So if you wanted to pay the actual out-of-pocket cost to Legal Zoom (something like $353 as I recall) I could set it up for you at no additional cost or fee, because it would get it off of my desk and get my money back.
