Question

My sons father lives in California and my son and I live in Texas, if he and I come to our own agreement about child support and child custody, write it out and get it notarized, if either of us breaks the terms of the agreement would the agreement hold up in court?

Answer

If there is no court order, all you have is a contract. The agreement would have to meet the criteria for a contract. You would need a family lawyer to help you with that. It might be less expensive to divorce or do a Suit Affecting Parent Child Relationship
