Can CPS in New York State call and tell a non-custodial parent about custodial parents involvement with a CPS investigation or does that breach confidentiality?



Answer

The reason for CPS to exist is to protect children. That being said they have wide legal discretion in their operation. They are looking after the children, not the parents. If the non-custodial parent has parental rights then CPS can certainly speak with them.
