Is capital structure relevant to the value of the firm?
It should be in regards to the forecasts regarding debt and equity markets. A firm more heavily exposed to debt will be exposed to the constant variable nature of that debt and other relevant debt covenants - eg over the last 5 years firms have favored debt due to cheap debt markets but are now suffering from high debt claiming high interest repayments etc. Equity is less of a drag on cash flow but can limit organizational effectiveness in regards to the greater power of shareholders.

How difficult is it to collect palimony? We were together 13 years and have an 11 year old daughter. He abandoned us then had her removed by CPS. We filed taxes together for several years. He knew I had no income, swore he'd never leave.
Answer
There is no such thing as palimony in California. You must either be married or have a domestic partnership to justify that claim.
Answer
Palimony is not a family concept. It is a contractual concept. This concept was developed by the court in the case of Marvin v. Marvin (1976) 18 Cal.3d 660 [134 Cal.Rptr. 815; 557 P.2d 106] In most cases there will not be a written contract between the parties. The court will then look at the conduct of the parties to determine the relationship between the parties. The relationship cannot be based on sex, nor can there be payment based on sexual services. In your case you been living as husband and wife for 15 years. this should provide evidence of your agreement.

in small claimes court in Fl. I am sueing a person for multible damages question is he smoked in my condo for 4 months and the lease he signed has a no smoking policy as it is in a smoke free building. If I repaint the entire inside of the condo to get rid of the nasty smoke smell would this be called a betterment.
Answer
Cleaning above and beyond normal due to smoke in violation of lease can be considered reimbursable. Painting of an apartment that potentially needed to be painted anyway, likely cannot. Not enough facts to actually answer your inquiry.

After a default had been entered and the respondant hasn't filed a response to the divorce or the default can the respondant go back to court after judgement had been entered or after default has been entered?
Answer
It depends on what the respondent is going to court for. The respondent could file a motion to vacate the default or default judgment, or set an OSC on a matter not addressed in your petition.
Answer
Mr. Roach is correct. The respondent can contest the default if there was any defect in service of process or any other aspect of the default proceedings. As he says, if any issues were not resolved by your default, the respondent can go in and ask that omitted issues be addressed. I would also add that the court retains jurisdiction over many aspects of divorce even once a "final" judgment is entered. Child custody and support are the number one thing that is never truly final until the children are grown up. Spousal support is also frequently under reserved jurisdiction to modify or terminate.
