I am the court appointed executor of my mom's estate. I have found over $ 35,000.00 unaccounted for in any receipts / statements. My brother was the POA. Do I have the right to make him show where that money went ? He wrote himself and relitives and ex wife checks out of her checking account which he was co owner., nothing in the memo for gift, service or repayment. Do I have the right to make him pay that money back ?
Answer
Yes. You would have to bring an action on behalf of the estate against him if he refuses.
