I would be inclined to think that if the employee is billing not only the per-message usage charges, but also the fixed periodic cost to have the service available, then it probably becomes a "company resource" even if the account is in the employee's name. In any case, if the employee here values the business relationship with the employer, this issue should be negotiated civilly until an understanding is achieved.

Apparently the foreclosure company was well aware of state and federal liens upon the owner of the property, but those liens remain unpaid after the real property was transferred into another person through a foreclosure company. I am wondering about the foreclosure company being complicit in a scam to move the property out of reach of the creditors - am I correct this should not be allowed?

No. You are entirely mistaken. The foreclosure company has absolutely zero obligation to do anything about any liens, senior or junior. All the foreclosure company is obligated to do is convert the deed of trust being foreclosed into a foreclosure deed to the buyer at the sale. This automatically wipes out any junior liens and inserts the buyer in the chain of title at the place of the lender. That's it.

You also appear confused regarding how liens work. Once a lien has attaches to property, it stays attached until paid or foreclosed. So you can't put property out of the reach of creditors by transferring it to another person. The transferee just winds up having to pay the debt or get the original debtor to do so, in order to clear the title of the senior liens.

Basically we will not be allowed to wear shoes which do not have a strap around the heel. And sandals are not permitted either. She claims this is to keep us from wearing flip flops.

Good question. I do not see that 8 CFR 274(a.12) has been amended yet to include this class (nor have the instructions to Form I-765 been amended to include this). I would leave it blank but make a note of it in your cover letter, or call USCIS (although I highly doubt they will be able to provide you with an adequate answer).

It doesn't matter who the original creditor is, it matters who has the judgment against you. If their attorney has retired, then someone had to take his/her place. Contact a consumer attorney, they should be able to find out who the new attorney on the claim is.

If there truly is no attorney, and no one to pay, then you could try a motion to strike the judgment, advising the court that you want to pay but there is no one to take it.

Again, you need a consumer attorney. Most of us give free consults.

I agree with Attorney Artim. It does not matter who the original creditor was. Debts can be sold at any time, either prior to a lawsuit or even afterwards. Whether the judgment can be challenged at this stage is a different matter. And you cannot get the judgment removed if it was properly entered against you. If it was not your debt (like in the case of identity theft) you would need to file a motion to set aside/open the judgment. Assuming it is granted you would then have the opportunity to prove its not your debt.

If you cannot challenge the judgment or if it was your debt, then your only option is to resolve the debt. Depending on how much the judgment was for it may or may not make sense to even challenge it. But you have to do the cost-benefit anaylsis.

Court records are public records. I would begin by going to the county where the judgment was entered and make a complete copy of the court file. The file will include the summons and complaint, including a return of service (showing how the complaint was served and when) as well as any attachments to the complaint like a credit card statement or bill of sale. The complaint or an attachment thereto usually will identify that this was for a credit card debt and will often identify the last four digits at least of the card number and the original creditor. However, companies like Citi or GE/Synchrony offer credit cards for lots of creditors - Sears and Home Depot are both issued by Citi for example, and GE/Synchrony issues Lowe's, JC Penney and other store cards. So the complaint may not tell you specifically what store the card was for and just may say Citi or GE/Synchrony.

Take the file to a consumer attorney and have the attorney review it to best see what all is involved and your options for resolving the debt.

My first piece of advice is to KEEP THAT RECORDING. Make a copy of it if you can. Hold it up to a recording device and make sure to also record the date and time of the message.

For some, it worked out because it happened that everything went right, but there was room for disaster. For others, the wills would not have been admissible as the formalities were not followed. The father wants out of the contract, and the son will not let him. There is no exit clause, but the son has breached the contract several ways. It says the son will provide quarterly reports, which he has not done. It says he will provide a business plan, which he has also not done. The contract also stipulates that improvements to the patent will be paid for by the son, so I told the father to stick a GPS on the side of the tool and force the son to patent it...repeat until he exits.

What is the cheapest/easiest way to get out of it? I can show damages of around $120,000 according to the son's numbers he has provided. The father doesn't want any money from his son, he just wants the contract invalidated. I was thinking Indiana has small claims court with a $6k limit. The father could sue in small claims for breach of contract. Does a small claims judge have the power to rule a contract invalid?

Assuming this is an Indiana case: This is not going to be solved in Small Claims Court if you have damages of $120,000.00. Small Claims Court may not have jurisdiction because of the fact that the invention is going to be valued at more than $6000 by both sides, so even if damages are not shown to be that much, you may have to file in Circuit or Superior Court.

The solution is to find a lawyer who can file for breach of contract and seek to rescind the contract on equitable grounds.

I agree with Voyle. I also suggest that not only do you seek rescission, but also seek damages. Since the father does not want damages, he can negotiate it away in exchange for rescission. He should hire counsel as he has already been burned without one.

If they have a K9 with them then they can certainly do a sniff around the vehicle. If they have reasonable suspicion, they can make you wait while they get a K9 to show up if they don't already have one. Heck, if they have probable cause they can just search your car. On the other hand, in the absence of reasonable suspicion or probable cause, they can't make you wait too long for a K9 because a traffic stop cannot last longer than necessary than it takes to effectuate the purpose of the stop.

I was put on administrative leave for the duration of my appointment and barred from all Navy Southwest property. The thing is I didn't even know that was an investigation until I was handed the Barrment letter so never had a chance to tell my side or disapprove what I believe are easy to disprove allegations. But that has to be some insertion point for that info, doesn't there? After the shootings at the navy yard they really clampdown on these types of issues and I understand. My wife is an employee of the Navy still and I want to keep her as safe as possible. I appealed the Barrment and the base commander basically said he made the best decision he could with info he had. Which is logic that would require a time machine for a successful appeal.

I believe my bosses actions were the result of a complaint I made to her just previous. So I have filed a retaliation complaint with the EEO. The unoficial complaint portion was a joke so I'm not too confident going foward but while waiting for a investigator to arrive I was offered mediation so possibly that will help.

But all of that stems from my EEO complaint. There has to be a way to get the other person side of the story in these situations without having to go through what is a very long and arduous EEO process. Though all this is terribly difficult to research online and since the shootings at the navy yard like I said things ratcheted up quickly. These codes establish guidelines for ethical behavior that can be applied directly to the daily decision-making process. No single association of business professionals has equal penetration within the total business environment; and no single business organization has equivalent sanctioning authority to bar and medical associations. It is probably because of this lack of a single dominating professional organization that no widely accepted code of business ethics has been devised.But the value of such a code is undeniable. It would set terms for evaluating the ethics of business decisions and would provide increased consistency in the standards we use to judge behaviors. In support of the adoption of such a uniform ethics code for businesses, Thomas Dunfee, Chairman of the Wharton School's Legal Studies Department, has proposed a list of eight fundamental principles of business ethics. As soon as I volunteered however, I was told that the legal department of where I worked was not allowing me to come back to work until I was medically cleared to come back. At that point, I was able to go onto disability leave and able to take care of these issues.

At the recommendation of the doctor that I saw, I decided that I was going to move to a less stressful environment of my home state of New York (I was previously working in New Hampshire but living in Maine). After I placed my transfer request, I was told that I needed to call around to find a new home location for my job. I was given the run around in that location, told that there would be a place for me here or there-but eventually, I was told that there would be no home location for me. I was also informed that my previous position had already been filled and that I would not have a place at my old location.

I have tried to contact my manager and their district office several times, all with no responses. I have looked over my benefits and found that I qualify for a severance package because I've effectively been laid off from my position, but no one has tried to contact me. This morning, I contacted the Employee Relations Hotline, but no one has returned my call-even though I was told that this was a priority. I have not been paid for a month now, even though I have sick and vacation time. I am unsure if there is any legal that could be done, but this is really starting to get out of control. So my question is-is this a situation that can be handled by the court and if so, what are my options?

Well, this begs the question, what then did you do with the money? If, for example, you spent on yourself then you may be looking at criminal action as well as civil. If it is just a civil suit and you do not show up, a judgment will be entered by default against you. The judgment will then have to be enforced. For example, they can try to seize any money in your bank accounts, they can get an order of wage garnishment so if you have a job that pays you by check they can force your employer to take payments out of your wages. If you have any assets they can try to seize them to satisfy the debt and of course the credit bureaus pick up the judgment so it will tank your good credit if that is relevant.

If you are "judgment proof" meaning no assets, no money to speak of, etc. then you likely have little to worry about unless it turns into a criminal matter, which is at least possible based on the little facts we have.

You need to consult an employment law attorney in NC. It does not matter how long ago the charges were or when you moved here.

You do not indicate whether the person was convicted of the crime or what other disposition occurred. If you were convicted and the question asks about convictions, then answer truthfully. If the question asks about arrests, then answer truthfully. If tyou lie and the employer finds out, you could be fired. I think it is better to be honest and provide an explanation than to lie.

However, you might also want to consult a criminal law attorney in Maryland to see if the charges can be xepunged.

I'd say probably not; I don't know of any actual decisions on the issue of wrong-sizing air conditioning units, but even assuming it could be proven to the court's satisfaction that 6 tons total a/c capacity was inadequate for a 4380 sq.ft. house in Oakley, I'm doubtful that there's an obligation on the builder to provide any particular amount of cooling capacity. Maybe the builder intended to keep the interior below 75, and you tried to keep it at 70, or something like that. Also, the failure of the a/c unit isn't necessarily because it's undersized ..... perhaps it failed for some completely independent reason, notwithstanding that it's also true that it was undersized.

File an Answer in the Eviction case, if there is still time. File an Objection to any garnishment they attempt to put on your wages or money. If you had a pending divorce haven when she signed the lease, and you or your children never lived in the rental property, you should succeed in getting out from under this debt. But, you have to be proactive in defending yourself and your assets. It will probably be more effective to have an attorney represent your interests.

Were the CDs and investments in joint accounts with your uncle or were they solely in your aunt's name? If the former, then it's his money. If the latter, then your mother definitely has rights. The disposition of all of those funds will need to be accounted for when the probate winds up.

You and your mother need to sit down with an experienced probate attorney and review all the information. It's possible that a letter from an attorney may put an end to the monkey business. If not, then you can discuss how to go about removing your uncle as the executor of the estate.

Both Ms. Golden and Mr. Vaughn-Martel are correct in their comments. Let me make it a little clearer on one point, your uncle's right to fees and reimbursement for expenses. He is entitled to reasonable compensation and that needs to be approved by the court. Moreover, his expenses need to reasonable. He is not entitled to keep what he wants or spend what he wants. He has a fiduciary duty to handle the estate for the benefit of all its heirs.

If you need assistance for your mother and she is not able to handle her own affairs, I would suggest you contact an attorney to prepare a Durable Power of Attorney with immediate effect and then proceed to represent your mother's interest in the estate.

Hello there--the answer is yes, this may be serious enough that it violates Title VII of the 1964 Civil Rights Act. The specific claim would be for what's called "hostile working environment." Your quitting would have to be presented as "constructive discharge," as if they'd fired you for discriminatory reasons--the theory is that in this environment no reasonable employee would stick around. The N-word is about the worst--there are some court decisions that say a single use of it is enough, and I think N mule is even uglier, if possible!--but it all depends on the surrounding facts. In a case like this it'd be great to have several plaintiffs with closely similar claims. I'm an experienced civil rights lawyer, former DOJ and ACLU, and I look at cases like this regularly. However, not only would it take years for your priority date to become current, but if you are not in legal status, you would have to apply for your immigrant visa outside the country & would not be able to re-enter the United States for 10 years.
